On 25-26 November 2010 in Nizhny Novgorod there will be a regional interdepartmental theoretical and practical conference “Judicial protection of civil and human rights and freedoms when restrictive measures in the form of custodial placement, release on bail and house arrest are used”. The conference is devoted to the case law concerning selection and prolongation of restrictive measures.

   The organizers are the Nizhny Novgorod Regional Court, interregional human rights NGO “Committee Against Torture”, Privolzhsky branch office of the Russian Academy of Justice, Judicial Department Directorate under the RF Supreme Court in Nizhny Novgorod region. The conference will take place in the building of the Nizhny Novgorod Regional Court at the address: 17 Bolshaya Pokrovskaya Street

   Among the participants there will be President’s Plenipotentiary Representative in the Volga Federal Territory Grigory Rapota, representatives of the RF Supreme Court and courts of the federal territory, Prosecutor General’s office, Government and Legislative Assembly of Nizhny Novgorod region, heads of various regional law enforcement agencies, specialists in international and Russian law of criminal procedure.  

   Under Russian law, courts are to determine whether restrictive measures for defendants suggested by the pre-trial investigation authorities – arrest, house arrest or release on bail – are lawful and well-grounded. Given that restrictive measures should not be picked arbitrarily, the RF Supreme Court is trying to improve the judicial practice in this sphere by forming coherent case law, identifying and eliminating moot points. For this purpose, in 2010 the Nizhny Novgorod Regional Court has generalized the practice of restrictive measure selection. The results of the analysis will be presented during the conference.
