Another criminal case is opened in relation to former head of Orenburg Colony Settlement No. 11 of the Department of Federal Penitentiary Service Filyus Khusainov; this time it is abuse of office – (Part 1 Article 285 of the Criminal Code of the Russian Federation). We remind that previously Khusainov has already been sentenced to three years prison term for abuse of office performed using violence or weapons. Also at the present time Khusainov is a defendant  in the criminal case of abuse of office and organization of sexual battery with violence committed by the group of persons by previous concert.

The plot of a new criminal case initiated in respect of Filyus Khusainov is the following. According to the version of the investigation, Khusainov ordered his employee to conceal the fact of the escape attempt of convict K. (as later he became the victim of sexual abuse we do not provide his personal data, – author’s note) in order to avoid negative consequences in his service for the mistakes he made and defects of the work that he did. Instead a faked report was prepared for convict K. for being supposedly arrested by the employees of the colony settlement for being drunk and showing resistance.

As a result of this falsification K. was put into the punitive isolation ward and later the conditions of this service of sentence were changed to more severe ones.

Besides, according to the version of the investigation, Khusainov arranged the violent execution of K. for his escape attempt. This is what the victim said later to the investigating officer: on 13 October 2013 Deputy Head of the Colony Settlement for Security and Field Work major Murat Kumarov took him to the punitive isolation ward. There he gave the order to other convicts to beat him. The victim was beaten severely, no one spared him, he fainted away several times. Kumarov helped him regain his consciousness pouring cold water on him. Several employees of the correctional facility were watching this including Filyus Khusainov who was the head of the colony at that time. After the beating Khusainov gave the order: “Make them line up here!” and around fifteen employees of the correctional facility entered the room. Two convicts from the group of the activists who followed the orders of the colony administration employees were holding K., the third one was given the order to touch the face and lips of K. with his genitals and so he did it. Deputy Head of the Colony Murat Kumarov was recording all this with the dashboard camera. And only when the torturer said that the film is ready, they stopped to abuse K. and the employees of the colony broke up.

Based on this fact in April 2016 the Investigating Division of the Investigative Committee of Russian Federation in Orenburg region opened a criminal case against Deputy Head of the Colony Settlement No. 11 for Security and Field Work Murat Kumarov. The criminal case was opened on the elements of crime described in p. “a” part 2, Article 132 of the Criminal Code of the RF (“Sexual battery performed by a group of persons by previous concert“) and p. “а” Part 3 Article 286 of the Criminal Code of the RF (“Abuse of office with the use of violence”). At the present time Murat Kumarov is under arrest. Later Khusainov was charged with the same crimes according to the same articles as Kumarov. However, the investigation considers that it was exactly Khusainov who organized the sexual abuse of the convicts, so he was charged with the relevant crimes.

Lawyer of the Committee for the Prevention of Torture Albina Mudarisova, representing the interests of the victim believes: “This is the fifth criminal case where the employee of Colony Settlement No. 11 is involved. And this correctional facility had a good reputation in the regional department of Federal Penitentiary Service; otherwise it would not have been called an exemplary one. I think that the prosecutor for supervising the correctional facilities and the chief of the Department of Federal Penitentiary Service of Russia in Orenburg region should pay attention to this fact and arrange compliance check with regards to the convicts’ rights in all colonies of the region”.
