A resident of Kuban’ died in hospital where he was delivered from the police. Criminal case is opened

A criminal case is initiated with regard to the fact of death of local resident Anatoly Tantsyrev in August 2019, detained by the police officers for committing an administrative offence. The criminal case is initiated with regard to the fact of inflicting death by negligence. According to the lawyers with the Committee Against Torture, representing the interest of the mother of the deceased, the results of the single-discipline expert panel may shed some light on the circumstances of his death, which has already been assigned by the investigator.

On 13 August 2019, Lyudmila Tantsyreva from the Dinskaya village applied to the Krasnodar branch of the Committee Against Torture. She told human rights defenders that on 30 July 2019 three police officers apprehended her son, Anatoly Tantsyrev, near her house because he was in the state of alcoholic intoxication and delivered to the District Police Department for the Dinsky District.https://www.youtube.com/embed/wOLMY1FCwOo

At about 10.30 of the next day, Anatoly suddenly felt bad at the police department and he fell and lost his consciousness. This moment was recorded by the video surveillance cameras. After about one hour he was hospitalized to the emergency care of the Dinsky Central District Hospital. On 13 August he died without regaining consciousness.

As Lyudmila Tantsyreva told the lawyers with the Committee Against Torture, at hospital she saw a large wound at the back of her son’s head.

According to the expert conclusion dated 13 September 2019, Anatoly Tantsyrev’s death was caused by: “extravasation under the dura mater of brain, complicated by compression of the brain matter and subdural hemorrhage which became the direct cause of death. Prescription of extravasation – about 2-3 weeks by the moment of death coming. на момент наступления смерти. Due to the prescription and extensiveness of the extravasation, absence of severe injuries, it did not appear possible to identify the mechanism of its genesis (whether it is a result of an injury or a disease). During the expert examination of the corpse an injury in the form of bruises on the back of the head from the left and right, which were caused by tangential impact of a blunt solid object as a result of a blow or a fall, and the prescription of the blow was about 2-3 weeks by the moment of the death”.

Back on 1 August, Lyudmila Tantsyreva applied with a crime report to the Investigative Department for the Dinsky District of the Investigative Department of the Investigative Committee of Russia for the Krasnodar Territory. Investigator Dmitry Vdovichenko three times refused to initiate criminal proceedings, not reporting about the procedural rulings passed either to the applicant or her representatives.
 
Only after human rights defenders and Lydmila Tantsyreva applied personally to Deputy Head of the Territorial Investigative Department Sergey Solntsev on 15 January 2020, the criminal case under part 1 of Article 109 of the Criminal Code of the Russian Federation (“inflicting death by negligence”) was opened, the investigation of which was assigned to another investigator, Aleksandr Markov.

Today, lawyers with the Committee Against Torture received a copy of this ruling.

“So far it is early to draw any conclusions. Now we are waiting for the results of the forensic medical expert panel evidence, because the previous one was conducted only formally and did not contain answers to the questions which the investigative authorities posed to the experts, – lawyer with the Committee Against Torture Anna Kotsareva, representing the interests of Lyudmila Tantsyreva, comments. – We expect that it will provide answers to the character of Andrey’s injuries and about their possible causes”.
