A Nizhny Novgorod citizen who has won a European Court case demands 300 000 roubles as compensation of damages incurred by the state

   Today lawyers of the Interregional Committee against Torture representing Viktor Buzhychkin’s interests lodged a suit with the Sovietskiy district court of Nizhny Novgorod claiming compensation of moral damage incurred to Mr. Buzychkin by the state.

You may remember that on 14 October 2008 the European Court of Human Rights found Russia guilty of violating Mr. Buzyvhkin’s rights under articles 3 and 13 of the European Convention on Human Rights (violent treatment and lack of effective remedies) when he was detained in remand prison IZ- 52/1 in horrible conditions.

In its judgment the European Court of Human Rights did not award Mr. Buzychkin compensation because he had not claimed any award.

When the ECtHR judgment stating violation of Mr. Buzychkin’s rights was officially acknowledged by the state, this enabled the victim to claim compensation on the domestic level.

Specialists of the Committee against Torture hope for a favourable decision of the district court.
