The court quashed the acquittal of the Kuban police officers who broke the leg of an arrested man after mistaking him for a criminal

The Fourth Cassation Court in Krasnodar decided on the victim’s complaint and the prosecutor’s request against the acquittal of the policemen. These officers were accused of breaking the leg of Yevgeny Manchenko, who was climbing over the fence of his own house, during his arrest.

The Cassation Court agreed to quash the acquittal of the policemen and return the criminal case to the Krasnodar Regional Court, as it was the court that in July 2023 acquitted traffic police officers Vyacheslav Zyabkin and Vladimir Tatarkov under the article of excess of authority (Article 286 of the Criminal Code). The court, therefore, will once again examine all the circumstances of the case and will adopt a new ruling. This would be the fourth trial in that criminal case — the first trial in the Prikubanskiy District Court of Krasnodar ended in the officers’ conviction, but later the sentence was overturned.

One should recall that in March 2019, Yevgeny Manchenko lost his keys and tried to climb over the fence of his own house. This scene was seen by policemen Zyabkin and Tatarkov, who were patrolling the street that day. As Mr. Manchenko recalls, the officers ran up to him, began to pull him off the fence and hit him on the leg with a rubber truncheon. According to Yevgeny, when he fell to the ground, they continued beating him. After hospitalization, the doctor diagnosed Mr. Manchenko with a closed fracture of his leg, which was later assessed by an expert as grievous bodily harm.
