The Prosecutor General's Office is reluctant to punish the policemen who had unlawfully arrested a participant in an opposition rally in Orenburg and dragged him into a police bus

Dmitry Teleshenko was arrested at a rally in Orenburg in 2021. This incident was caught on video footage of some eyewitnesses. For instance, it can be seen how people in civilian clothes abruptly grabbed the arms and legs of the young man, who was standing still and not shouting any slogans, and carried him to a police bus. As Dmitry recalls, along the way, the police «rammed» a passer-by with him, and when asked to be brought to his feet, they hit Dmitry in the cheekbone. Subsequently, Mr. Teleshenko was detained and placed in a special detention center for 48 hours.

The lawyers representing Dmitry’s interests went to the court, which stipulated that there had been no grounds for using physical force against Mr. Teleshenko, and that the actions of unidentified officers could not be considered lawful. Dmitry was awarded 15 000 rubles in compensation, and he also received an apology from the Ministry of Internal Affairs.

And yet, Dmitry’s lawyers believed that the investigation should establish the identities of the policemen and punish them for the unlawful use of violence against Mr. Teleshenko. However, the Investigative Committee refused to open a criminal case for excess of authority. The investigators considered that the officers did not violate the Law «On the Police» and acted according to the relevant rules. The Prosecutor General’s Office expressed a similar view.

The commentary of the Crew Against Torture: «The Prosecutor’s Office did not answer the main question: why the use of force against Mr. Teleshenko, which the court declared unlawful, is not subject to qualification under the article on excess of authority (Art. 286 of the Russian Criminal Code). We will therefore apply directly to the Prosecutor General, Mr. Igor Krasnov, so that he can answer that question
