Today, the Vyksa City Court sentenced the policeman named Aleksandr Gutov to 4 years in a соrrectional colony on charges of ill-treatment against Aleksandr Sharfutov. At the last moment, the prosecutor asked the court to sentence Mr. Gutov not for the act of torture (Part 4 of Article 286 of the Criminal Code), but for the milder part of that article — excess of authority with the use of violence (Part 3 of Article 286). The court agreed with the prosecutor.

In October 2022, Mr. Gutov used a stun gun several times and punched a detained person, Mr. Sharfutov, in the face because of a request to bring a blanket to the cell.

Mr. Sharfutov recalls the following: «He hit me on my arms, legs, thighs. One blow landed under the right eye. The wound started bleeding; there was blood all over my cheek and clothes

The incident was caught on surveillance camera at that police station. The recording also shows that a second police officer, Ilya Sokolov, is watching Mr. Sharfutov’s ill-treatment, but does not take any steps to stop his colleague. Later it turned out that Mr. Sokolov was not aware that he had to stop the violence against the detainee and inform his superiors about it, as he had not read the law «On the Police.» A criminal case was opened against Mr. Sokolov, but was subsequently dropped; the man was only punished by disciplinary measures.

Only a criminal case against Aleksandr Gutov reached the court; it involved the article on excess of authority with the use of torture (Part 4 of Article 286 of the Criminal Code). However, at the recent hearing, the prosecutor asked to reclassify Mr. Gutov’s crime to the milder part of that article (excess of authority with the use of violence — Part 3 of Article 286).

During the trial, Mr. Gutov changed his testimony several times. In the investigation phase, he made a confession, but later claimed that Mr. Sharfutov himself came across his fist and a stun gun. At the court hearing, a third version also appeared: Mr. Gutov allegedly did not punch Mr. Sharfutov, but only reached out with his hand because he saw a suspicious object. Gutov’s position regarding the stun gun changed similarly. At first, the defendant indicated that he did not use it on the detainee at all, and later he said that Mr. Sharfutov himself came across the stun gun.

Today, the Vyksa City Court sentenced Aleksandr Gutov to 4 years in a correctional colony for excess of authority with the use of violence (Part 3 of Article 286), also banning him from holding positions in the state service for 2 years.
