The decision of the Leninsky district court of Grozny awarding compensation for unlawful actions of the investigation authorities (investigator of the Interdistrict Investigation Department under the RF Prosecutor’s Office for Chechnya) has entered into force.

   Today the civil division of the Supreme Court of Chechnya has upheld the decision of the Leninsky district court of Grozny dated May 15, 2010 awarding Muslim Kulayev compensation of moral damage incurred by investigator Tapayev’s actions. The judges agreed with the reasoning of CAT lawyers who motivated the lawfulness of the Leninsky court’s decision.   

An award was made to Mr Kulayev to redress the damage incurred to him by the refusal of the investigator from the Grozny Interdistrict Investigation Department under the RF Prosecutor’s Office for Chechnya to provide the materials of the check.

In the nearest future we are going to ask the Prosecutor’s Office to bring a recourse action against the responsible person, i.e. investigator Tapayev, since so far the compensation is to be paid from the taxpayers’ pocket.
