A Zavolzhye citizen demands 100 000 rubles as compensation of moral damage incurred by an investigator

The Multiregional Committee against Torture filed a suit to the Nizhegorodskiy district court of Nizhny Novgorod in the interests of Ms. Marina Veselovskaya from Zavolzhye. Ms. Veselovskyaya demands that the Investigation Administration of the Investigation Committee for Nizhny Novgorod region and the Federal Treasury should compensate the moral damage incurred by the actions of investigator Burenkov from the Gorodetsk Investigation Department under the RF prosecutor’s office.

In his refusal to start criminal proceedings under Ms. Veselovskaya’s complaint about police abuseof 15.08.2008 he mentioned that Marina had committed an administrative offense and was liable under art. 12 of the RF Administrative Code.

However, as it was reported earlier, on 13 October 2008 the Gorodetsk city court issued a ruling stating that the refusal was unlawful and ill-founded. The court also specified that the investigator’s allegation about an administrative offense was unfounded and unsubstantiated. This means that on behalf of the RF Investigation Committee investigator Burenkov has accused Ms. Veselovskaya of an offense without any ground and besmeared the woman.  According to the RF Civil Code, a defamed individual has the right to compensation of moral damages.
