The Nizhny Novgorod Regional Court disposed of the appeal of Oleg Kuptsov, a deputy prosecutor of Avtozavodsky district of Nizhny Novgorod, against the decision of the Avtozavodsky District Court of 1 November 2007.
As you may know the Avtozavodsky District Court had upheld the complaint of Yuri Sidorov, a lawyer of the Committee Against Torture, submitted in the interests of Sergey Orekhov and Dmitry Rusov against the decision of refusal to open a criminal case made by the prosecutor’s office after it had considered the complaint of Mr Rusov and Mr Orekhov against the unlawful actions of policemen.
In the complaint Yuri Sidorov asked to reverse the decision of refusal to open a criminal case.
On 1 November the Avtozavodsky District Court upheld the lawyer’s complaint and annulled the decision of refusal to open a criminal case.
Deputy prosecutor of the Avtozavodsky district Kuptsov did not agree with the court’s decision and filed an appeal against it to the Criminal Chamber of the Nizhny Novgorod Regional Court. In the appeal Mr Kuptsov asked to quash the court’s decision.
However the Criminal Chamber of the Nizhny Novgorod Regional Court did not agree with the deputy prosecutor and dismissed the appeal upholding thus the decision of the Avtozavodsky District Court.
One more unlawful and ungrounded decision of the prosecution service not to open a criminal case in respect of the complaint of two minor boys – Dmitry Rusov and Sergey Orekhov, claiming to have been violently treated in police – will be annulled and the case will be subject to an additional inquiry.
