Mr. A.V. Sharov, a deputy prosecutor of Dzerzhinsk City, was brought to account

 On 18 December 2006 the NN CAT applied to prosecutor of Nizhny Novgorod Region V.A. Maksimenko with a statement concerning the refusal to accept a complaint of a crime by deputy prosecutor of Dzerzhinsk City A.V. Sharov. It had taken place on 27 November 2006 when Ms. Elena Polyashova, after her husband had been beaten by policemen, had applied to deputy prosecutor of Dzerzhinsk City A.V. Sharov. She wanted to submit a complaint of the crime, committed by policemen in respect of her husband. According to Ms. Elena Polyashova, Mr. Sharov replied to her that “her husband was an adult person and she was not entitled to submit a complaint of a crime on his behalf”. The Committee attached additional explanations of Ms. Elena Polyashova to the statement.  

    On 16 January 2007 senior prosecutor of the first division of the department for the supervision of investigation and inquest of the Nizhny Novgorod Regional Prosecutor’s Office S.M. Yakovlev forwarded a letter to the NN CAT which read that “as instructed by prosecutor of Nizhny Novgorod Region V.A. Maksimenko an internal inquiry had been initiated concerning the submissions of Ms. E. Polyashova”. It was also stated in the letter that to date the inquiry was incomplete, and the NN CAT and Ms. E. Polyashova would be subsequently informed of the results. However, after the time-limit established by the relevant law had expired, neither the Committee nor Ms. E. Polyashova was informed of the results of the inquiry. So the Committee submitted another complaint against non-notification by the Nizhny Novgorod Prosecutor’s Office of the results of the inquiry, carried out in respect of deputy prosecutor of Dzerzhinsk City A.V. Sharov.

    It appears from the letter (p.1p.2) of head of the department for the supervision of investigation and inquest of the Nizhny Novgorod Regional Prosecutor’s Office V.V. Igoshin that having considered the statements of the NN CAT, the regional prosecutor’s office “established that deputy prosecutor of Dzerzhinsk City A.V. Sharov had violated the Instruction set up by the Order of the General Prosecutor of the Russian Federation, when accepting Ms. E. Polyashova and was made answerable for the violations”.

    It is also said in the letter that senior prosecutor of the first division of the department for the supervision of investigation and inquest of the Nizhny Novgorod Regional Prosecutor’s Office S.M. Yakovlev who did not inform the NN CAT of the measures taken as a result of the inquiry in proper time became a subject for discussion at an executive meeting held by the head of the department for the supervision of investigation and inquest. Mr. Yakovlev was warned that he would be made accountable for such violations in case they repeated.
