Policemen from Bashkortostan who ill-treated citizens have been sentenced.

  On 26 March 2007 the Oktyabrky City Court (Bashkortostan)brought in a verdict of guilty in respect of major Ayrat Sharafutdinov and captain Sergey Bayguzin under article 139 of the Criminal Code (unlawful intrusion into a home committed against the will of the liver, associated with the use of violence or threat of it, committed with the use of official power) and article 286 (abuse of official power entailing serious violations of citizens’ rights and interests associated with the use of violence or threat of it committed with the use of special devices).

    Whereas major A. Sharafutdinov according the psychiatrists suffers from a mental disease  and committed the crimes in a mentally insane condition he was exempt from criminal liability. Taking into account that Mr. Sharafutdinov have committed a number of crimes, including serious ones, associated with the use of violence against citizens and suffers from a mental disease, and is not actually aware of a public danger their actions entail, being unable to realize what he does, the court decided that Mr. Sharafutdinov is dangerous for society and people surrounding him. In this connection the court prescribed for him a course of compulsory treatment in a closed specialized psychiatric clinic.

    Captain Bayguzin was sentenced to 3 years and 6 months of imprisonment (on two years’ probation) with subsequent prohibition on serving in law enforcement and governmental agencies.

    The NN Committee Against Torture,where the victims of unlawful actions on the part of Mrs. Bayguzin and Sharafutdinov applied to, has granted them legal aid and a lawyer to represent them before the court. Besides, a renowned expert in psychiatry and psychology from Nizhny Novgorod, the director of the Rehabilitation Center of the NN Committee Against Torture Mr. Vladimir Gursky has consulted the victims.
