Yesterday, in Grozny, the Chechen representation of INGO “Committee Against Torture” conducted a training entitled “Legal mechanism for claiming compensation of moral damage inflicted by an ineffective investigation”.
Lawyers and legal representatives actively participated in the discussion and shared the challenged they had faced in proving that moral damage had been sustained, mentioning that the CAT’s developments deserved close attention and extensive application in legal practice.
Training participants received hand outs complied on the basis of Committee’s public investigation cases. During the training, CAT workers furnished real examples when the legal mechanism in question had been implemented to obtain compensations of moral damage incurred by an ineffective investigation. They also demonstrated examples of statements of claim and judicial decisions taken by Nizhny Novgorod regional and Chechen republican courts under those claims.
You may remember that on November 2, 2009 the Sovietsky district court of Nizhny Novgorod obliged the RF Finance Ministry to pay 5000 rubles to Azerbaijani Emil Dadashov as compensation of moral damage incurred to him by the ineffective investigation carried out by the Investigation Committee and delays.
On July 8, 2009 the Sovietsky district court of Nizhny Novgorod awarded 500 rubles to Nizhny Novgorod resident Sergey Lyapin whose rights had been violated by deputy head of the Dzerzhinsk Interdistrict Investigation Committee Kokin and an investigator subordinate to him.
Following the decision of the Dzerzhinsk city court dated May 5, 2009 the RF Finance Ministry paid 1000 rubles as compensation of moral damage to Mr. Anikin whose rights had been violated by the Dzerzhinsk Interdistrict Investigation Department staff.
In August last year the Leninsky district court of Grozny (Chechnya) fully sustained the suit of Muslim Kulayev (30 000 rubles). Mr. Kulayev insisted on compensation of moral damage inflicted to him by an unlawful refusal to instigate criminal proceedings issued by the Grozny Interdistrict Investigation Department and refusal to provide him the materials prepared upon the results of the check carried out under his application.
