By not sustaining the claim of the defendants under the criminal case of a Nizhny Novgorod girl – Mr. Milkov and Mr. Serov,  former workers of the Prosecutor’s office whom she accused of battering and raping her– the Nizhny Novgorod court preserved a chance for Russia to restore the rights and interests of Olga Maslova on the domestic level.

On June 6, 2008 the Nizhny Novgorod district court did not sustain the claim of the defendants under criminal case № 699499 (Olga Maslova’s case) and accepted the position of the Prosecutor’s office representative and Mr. Yuriy Sidorov, Ms. Maslova’s lawyer provided by the Committee against Torture.

Mr. Milkov and Mr. Serov who acted as defendants under the above mentioned criminal case complained about the fact that the ruling to stop criminal proceedings under case № 699499 issued by deputy Prosecutor of Nizhny Novgorod region Mr. Belov on the 22nd August 2005 had been cancelled.

In other words, Mr. Milkov and Mr. Serov demanded that the court should eliminate any further possibility for the Prosecutor’s office to resume the criminal case and thus strike out the issue of making them liable. The court, however, disagreed with the arguments provided by former Prosecutor’s office workers.
