The Committee Against Torture has ensured instigation of criminal proceedings under the application of Nizhny Novgorod citizen Ilya Lapin alleging police abuse

The Nizhegorodsky District Investigation Department of the Investigation Administration of the Russian Investigation Committee for Nizhny Novgorod region has instigated criminal proceedings under p. 3 of Art. 30 and Art. 105 of the Russian Criminal Code (“attempted murder”) upon the fact of attempted murder of Ilya Yuryevich Lapin.

According to the investigation, on March 9, 2011 the applicant left home with a law enforcement agent he knew and returned with injuries, including a head injury. After that he was taken to hospital no.39.

The Committee disagrees with the official version, as Lapin was abused by people who at that moment were acting in their official capacity, i.e. as law enforcers. Therefore, being state agents, these individuals shall be criminally liable for tortures.

In the nearest future the Committee Against Torture will start a public investigation upon the results of the preliminary check  conducted under the application of Mr. Lapin’s mother Maria Arifovna Lapina. CAT lawyers will collect and evaluate evidence in support of the applicant’s allegations that his tormentors were acting in their official capacity of policemen.

If the allegations are confirmed, the Committee will insist on the instigation of criminal proceedings under Article 286 of the Russian Criminal Code (abuse of office).
