The judgment for the policeman guilty of killing Alexander Anoshin from Nizhny Novgorod has entered into force

   Today the criminal division of the Nizhny Novgorod regional court examined the policemen’s cassation claim and left the verdict delivered by the Sovietskiy district court of Nizhny Novgorod of 1 August 2008 under the case of Mr. Anoshin’s murder at the district detoxification centre unaltered.

You may remember that in August the Sovietskiy district court found officer Maslov guilty under p.1 of art.105 of the RF Criminal Code and p.3 of art.286 of the RF Criminal Code and sentenced him to 14 years of imprisonment in an increased security penal colony.

Mr. Maslov’s colleagues who were also accused under this case – former police officers Ageyev and Antonov – were found guilty of negligence and released from penalty due to limitation of action. 

In summer 2002 Mr. Alexander Anoshin from Nizhny Novgorod was detained by the police because he was intoxicated in a public place and taken to the medical detoxification centre of the Sovietskiy Directorate of the Interior. At night he died.

Mr. Anoshin’s relatives applied to the Committee against Torture, it conducted an investigation and revealed alleged violations of art.2 and 13 of the European Convention on Human Rights and Fundamental Freedoms(«Right to life» and «Right to an effective investigation» correspondingly).   On 19 December 2005 the application was registered by the European Court of Human Rights.

At present the injured party together with the Committee against Torture decides upon suing the state for damages.
