As we reported yesterday, on Friday 9 March 2007 the criminal panel of judges of the Nizhny Novgorod Regional Court quashed the decision of the Pavlovo City Court to take minor Dmitry Andronov into custody as judicial restraint.
In accordance with the statute “On Custodial Restraint” the administration of a detention center is to release a person whose restraint has been annulled immediately. A secretary of the court handed the court’s ruling to the administration of the detention center just after the trial in the presence of Dmitry Andronov’s counsel.
However, despite the ruling and the law, the administration of the detention center refused to release Dmitry Andronov saying that “the working day was off” but promised Dmitry’s mother that her son would be “the first” to be released on Monday morning.
When this news reached the NN Committee Against Torture our experts at once decided to go to the detention center.
On the evening 9 March 2007 when the officials of the detention center refused to execute the ruling of the Regional Court and release the teenager, experts of the NN Committee Against Torture together with Dmitry Andronov’s mother and his counsel informed the Regional Prosecutor’s Office of the fact that the administration of the detention center ignored the court’s ruling. This information was also brought to the attention of the Central Police Department of Nizhny Novgorod Region (GUVD). The press secretary of the GUVD, colonel A. Gorbatov, at once addressed the highest officials of the Central Regional Department of Federal Service of Penalty Execution (GUFSIN). The result of the adopted measures was that on 10 March 2007 at 10 a.m. Dmitry Andronov was released.

We need to mention that the actions of the administration of the detention center, which refused to execute the court’s ruling and release Dmitry upon the receipt of the necessary documents from the Regional Court, is a gross violation of the existing laws.
We will lodge a complaint against the unlawful actions of the officials with a court on 12 March 2007.
