The state prosecution demands 5 years of imprisonment for Nizhny Novgorod police officer Sergey Biryukov charged with battering an Azerbaijani

 Today the public prosecutor has voiced such position during an oral hearing in the Nizhegorodskiy district court of Nizhny Novgorod under the case of Emil Dadashov’s battery by Sergey Biryukov from the District Directorate of the Interior charged with abuse of powers.   

The preliminary investigation showed that defendant Biryukov had acted intentionally, contrary to his duties, without an order issued by his heads and abusing his powers; he got into the cell for administrative detainees where Mr. Dadashov was kept.  When Mr. Dadashov refused to give the officer a cigarette, the latter kicked him once on the body and hit him on the head with his head. The police officer is charged under cl. «а», «b» p.3 art. 286 of the RF Criminal Code (abuse of official powers with violent treatment). The data obtained during the official investigation is confirmed by the public investigation conducted by the Committee against Torture.

The state prosecution insists on punishment connected to factual deprivation of liberty for 5 years. Besides, the Prosecutor’s office requests that Mr. Biryukov should be deprived of the right to work in state and law enforcement bodies for 3 years. The judgment under Emil Dadashov’s case will be delivered by judge Pyryev on 2 April 2009 at 9:00 in the Nizhegorodskiy district court.

The Interregional Committee against Torture invites mass media for proclamation of the verdict under this case important for the Russian society.
